Terms of Business

Definition:

Infinity Sim Wings Limited, is a company incorporated in England and having its registered office at Preston Park House, South Road, Brighton, East Sussex, England, BN1 6SB (hereinafter referred to as iSW).

Simulator is an aircraft training device.

Customer is any person attending Simulator bookings to include specific courses.

General:

1. Bookings must be paid in full before confirmation and acceptance by iSW, and prior to the booking date.

2. The Customer shall accept that once payment is made for a Simulator booking it is non-refundable unless cancelled by iSW. The Customer may request a date/time change for previously confirmed and paid bookings without additional charge, notice must be provided via email of such a request and to be received by iSW not less than ten (10) days before such date.

3. Refunds will not be provided for late arrivals or no-shows, iSW will try to accommodate late arrivals on a discretionary basis.

4. If the Simulator develops a fault resulting in the termination of the booking/training, then a partial refund or another booking date will be offered.

5. Any costs The Customer incurs from travel or accommodation will not be reimbursed or subsidised by iSW for any reason whatsoever.

Warranties, Indemnities and Insurance:

1. The Customer will not hold iSW responsible for any personal injury, death, loss or damage to property or inconvenience unless caused by gross negligence by one of iSW officers and/or employees.

2. iSW does not warrant that any person participating in the Simulator training/bookings will achieve any specific level of training nor qualify for any license, certification or rating whatsoever as a result of the training performed on the Simulator.

3. The Customer shall not use the Simulator for any unlawful purpose including (without limitation) the committing of any:

(a) Offence under any applicable terrorism laws; and

(b) Violation or non-compliance with rules of the Government and any appropriate regulatory authority.

Approvals, Consents and Instructions:

1. The Customer will be required to show a copy of a passport/valid ID card and/or flying license upon arrival at iSW premises. Failure to do so may result in cancellation of the booking or training session with no refund.

2. The Customer accepts that it must comply with all safety demonstrations, Simulator rules and safety procedures. Where The Customer does not comply, The Customer shall accept all responsibility and may be liable for any injury to self or others, loss or damage to property or inconvenience.

3. No food or drink is allowed in the Simulator, and the Customer accepts that subsequent damage to the Simulator by taking any food/drink or banned substance into the Simulator will result in The Customer being liable for any damage.

4. Training with iSW does not secure or guarantee any subsequent license certification.

5. The Customer does not hold the right to distribute, copy or resell any training manual, course structure or intellectual property of iSW to any third party.

6.For group bookings, The Customer shall ensure that iSW is advised via email of the names of all booking participants at least seven (7) days prior to the booked date.

7.The minimum acceptable age is 18 years for any Customer attending iSW bookings.  

Force Majeure:

1. Neither iSW nor The Customer shall be responsible or liable for any non-performance of any of its obligations hereunder to the extent that such non-performance is due to force majeure which, for the purposes hereof, includes but is not limited to strikes, lock outs, acts of nature, acts of Government in its sovereign or contractual capacity, fire, power cuts, explosions and any other event beyond the reasonable control of iSW or The Customer.

 2. In the event that any such event occurs, iSW or The Customer shall promptly notify the other party, and the parties shall use all reasonable efforts to minimise the effect hereof on the schedule and performance of any outstanding bookings.

Law and Disputes:

This Agreement shall be governed by and interpreted in accordance with English Law.
